Article 4 is replaced by the following:
'Article 4
Signs of which a European
Union
trade mark may consist
A European
Union
trade mark may consist of any signs, in particular words, including personal
names, designs, letters, numerals, colours as such, the shape of goods or of their packaging, or sounds,
provided that
generally available technology is used
and such signs are capable of
（
a
）
distinguishing the goods or services of one undertaking from those of other undertakings;
and
（
b
）
being represented
in the Register of European Union trade marks
in a manner which enables the
competent authorities and the public to determine the
clear and
precise subject
matter
of the protection
afforded to its proprietor.'

。這項廢除「圖文表示」要件的改變並不是對商標註
冊標的無限延伸擴大，而是對於標的提供更靈活的保護，如此一來，更加提高
法律的確定性。「圖文表示」要件似乎即將要被打破，目前歐盟執委會的提案
草案並非最終版，在該法規提案生效之前，「圖文表示」仍為商標申請註冊之
前提要件。
